On Monday, attorneys for Kim Davis, the Kentucky county clerk who was jailed for refusing to issue marriage licenses, filed an emergency injunction with a federal court to have her released from prison. The filing also seeks to have Kentucky Governor Steve Beshear accommodate Davis’ “religious conviction” and not compel her to issue same-sex marriage licenses, said the Liberty Council in a statement.
“The motion requests an injunction pending appeal for an exemption from the Governor’s mandate that all county clerks issue marriage licenses,” the statement said.
Again, completely irrelevant. The issue here is that a federal judge lacks the power to sanction a state employee for contempt of court in her failure to comply with a decision or opinion of a judiciary of a foreign jurisdiction. The jurisdiction in question is foreign in the matter of marriage because it is outside the scope of its enumerated powers.
One, United States has no jurisdiction in that matter. You don’t ask the barber if you need a haircut. You don’t ask a federal judge if he has jurisdiction.
Two, it’s thereoretically impossible for her to have failed to comply with the law because judges aren’t in the law business.
It’s an idiot jurisdiction that thinks judges write law. It’s an idiot organization that needs to be escorted back to its hole.
